Terms of Service

These Terms of Service ("Terms") govern your use of the BookForge platform (the "Service"), available at bookforge.space. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Acceptance of Terms

By accessing or using BookForge you agree to these Terms and our Privacy Policy, which is incorporated by reference into this agreement. If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of the Service

BookForge is an AI-assisted book creation platform that lets users structure, write, illustrate, and export books in formats such as Word, EPUB, and PDF. The Service uses language and image models from third-party artificial intelligence providers (including, without limitation, Anthropic, OpenAI, xAI, and Pollinations.ai) to generate content based on the user's instructions. BookForge does not guarantee any specific sales results, literary quality, factual accuracy, or absolute originality of the generated content, and the user is responsible for reviewing, editing, and verifying all content before publishing or distributing it.

3. Accounts and Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You are responsible for keeping your password confidential and for all activity that occurs under your account, and you must notify us immediately of any unauthorized use. During the beta phase, access may be limited through individual access codes with a maximum number of books allowed; attempting to circumvent these limits is a violation of these Terms.

4. Subscription, Billing, and Cancellation

BookForge is a recurring monthly subscription service. By subscribing, you authorize automatic recurring charges (monthly, unless a different billing cycle is stated at signup) to the payment method you provide, until you cancel. Your subscription automatically renews at the end of each billing cycle unless cancelled beforehand. You may cancel at any time from your account or by contacting us; cancellation takes effect at the end of the current billing cycle and does not entitle you to a prorated refund for unused time, unless required by applicable law. We reserve the right to change subscription prices with reasonable prior notice; continued use of the Service after such notice constitutes acceptance of the new price.

5. User Content and Intellectual Property

You retain the intellectual property rights to the content you create using BookForge (ideas, titles, chapters, covers, and illustrations generated from your instructions), to the extent permitted by copyright law applicable to AI-assisted content. You grant us a limited, non-exclusive license to store and process that content solely to provide you the Service. BookForge, its brand, logo, source code, platform design, and the "3×3 Method" are the exclusive property of the Service operator, and no license to them is granted beyond the intended use of the Service.

6. Acceptable Use

You agree not to use the Service to: generate illegal, defamatory content, content that infringes third-party rights, hate speech, or material that exploits minors; attempt to breach the platform's security or access other users' accounts; resell or redistribute access to the Service without authorization; or use the Service in a manner that abusively exceeds the reasonable-use limits of the third-party APIs that power it. We reserve the right to suspend or terminate accounts that violate this section.

7. Third-Party Services

BookForge relies on artificial intelligence and infrastructure services operated by third parties (including, without limitation, Anthropic, OpenAI, xAI, Pollinations.ai, and our web hosting provider). The availability, speed, quality, and accuracy of generated content depend directly on these third parties, over which we have no control. BookForge is not responsible for outages, errors, delays, price changes, service discontinuation, or incorrect or inappropriate generated content resulting from technical failures, policy changes, or unavailability of such third-party platforms. In the event of prolonged third-party outages, we will make reasonable efforts to inform users, but we do not guarantee resolution times.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, ORIGINAL, OR SUITABLE FOR ANY SPECIFIC PURPOSE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SERVICE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF REVENUE, DATA, USE, OR PROFITS, ARISING FROM THE USE OF OR INABILITY TO USE THE SERVICE, INCLUDING FAILURES OF THIRD-PARTY APIS OR PLATFORMS DESCRIBED IN SECTION 7. THE OPERATOR'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY THE USER IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not fully apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Service operator, Federico Rubén González, and any successor entity, from any claim, damage, loss, or expense (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) content you generate or publish using the Service; or (c) your violation of any third party's rights.

11. Operating Entity

BookForge is currently operated by Federico Rubén González, individually (as a sole proprietor), while a formal entity (a limited liability company — LLC — or a registered assumed business name — DBA) is being formed in the State of Texas, United States. Any reference in these Terms to "BookForge," "the Service," "we," "us," or "the Company" refers to Federico Rubén González and/or the successor entity that may in the future assume operation of the Service. Any future transfer of the Service's operation to such an entity will not require user consent and will not alter the rights or obligations set out in these Terms, and such successor entity will assume all rights and obligations contained herein.

12. Termination

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, for non-payment, or for any other reason at our reasonable discretion. You may terminate your account at any time. Upon termination, the sections of these Terms that by their nature should survive (including, without limitation, intellectual property, disclaimer of warranties, limitation of liability, and indemnification) will remain in effect.

13. Changes to These Terms

We may modify these Terms at any time. We will post the updated version on this page with a new "last updated" date. Continued use of the Service after such changes are posted constitutes your acceptance of the modified Terms. If the changes are material, we will make reasonable efforts to notify you by email or within the platform.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in Texas, and the parties irrevocably submit to such jurisdiction and waive any objection based on inconvenient forum.

15. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right under these Terms does not constitute a waiver of that right. These Terms, together with the Privacy Policy, constitute the entire agreement between the user and the Service operator regarding their subject matter.
